How is the Value of an Accident Claim Determined?

Posted on

The value of an auto accident claim is never an arbitrary number; it’s based on specific calculations that take into account the extent to which you were injured. To determine the value of a car crash claim, injury may include damage to your personal property, medical bills, lost wages and potentially any long-term effects of the crash. Properly documenting these injuries is the key to getting the right valuation and the settlement you deserve for your auto accident claim.

Property Damage Value
Property damage is typically the easiest part of the valuation of an auto accident claim. Most of the time, you’ll take your car to a designated inspector who will determine how much damage was done, and how much it will cost to repair your car. That’s the property damage value. In some cases, if you were carrying valuable property in your car that got damaged, you can also add the cost of replacing or repairing that property. For example, if you had a laptop that got ruined in the car with you, you might be able to claim the cost of replacing the laptop.

Medical Bills
Medical bills are extremely important to document as part of assigning value to an auto accident claim. In many cases, the largest portion of the value of an auto accident claim is based on repaying medical bills incurred as a result of the accident. For example, if you incurred $25,000 in medical bills and the damage to personal property was valued at $5,000, you have a minimum of $30,000 in damages – the medical portion making up the majority of the cost.

It may be advised to finish medical treatment before settling an auto accident claim so that you have a hard number for the cost of the medical bills. You can settle based on an estimate, but if the medical bills go beyond the estimate, you have no avenue for recovering those additional costs.

Other Injuries
The purpose of auto accident claims under the legal system is to restore you to the state you were in prior to the accident. This sometimes means you incur additional injuries that must be compensated. For example, if you have to use vacation time or sick time as a result of the accident, you may be eligible to recoup lost wages. Other injuries may also include long-term disability or vocational retraining costs if you’re no longer able to do your job

Brutal Wreck Kills Both Victims

Posted on

Two unidentified victims of a devastating car crash were killed this last Sunday Morning.

Police report that a Jeep carrying a man and woman drove straight into telephone pole smashing the engine compartment all the way into the back seat. Neighbors nearby recall the accident, with one saying the impact was so strong it shook her whole apartment and woke her up from her sleep.

Rescue units arrived almost simultaneously to the crash site, but it was already too late as the victims were killed instantly. Investigators are not certain what the cause of the accident was, but it has been determined that neither person was wearing a seat belt and apparently the breaks were not used because no skid marks were present at the scene.

The neighbor, still shaken from the fatal wreck, spoke solemnly in wake of the death saying how it makes you wonder “who were they” and hopes that this accident serves as a reminder to others to be careful while driving.

Although this neighbor’s thoughts are well intended, the truth is that most times atrocious lessons such as the one aforementioned still do not make it through to people. There will always be new drivers on the road, old drivers who forget, new obstacles, new reasons to not pay attention to the road, and on and on. Tragedies of the road just come with the territory. Every time you get behind the wheel of car, you are taking that risk.

While we hope that you never have to become a victim of such misfortunes, it would be wise and beneficial to your recovery to get in touch with an accident attorney who is familiar with this sort of law and can make sure that all of the proper steps are taken post this catastrophe. A skilled wrongful death attorney can relieve some of your suffering and make sure that it never evolves into any financial shortcomings.

Give yourself the benefit of having something by your side who is willing to passionately fight for you and your family’s well-being.

Elderly Woman’s Life Claimed by Alcohol/Drug Free Car Crash

Posted on

An elderly woman leaves her family grieving this Wednesday after she was killed in a head-on-crash on Barrington Road in Hoffman Estates.

Just after 4:00 a.m, her southbound traveling sedan collided with a northbound SUV. The man in the SUV was luckily not injured while the woman’s fate was not so fortunate as she was pronounced dead an hour after the crash at the St. Alexius Medical Center.

Investigators believe that neither alcohol, drugs, speed nor weather are factors in causing the fatal crash. The names of the victims have not been released. Traffic was shut down on northbound lanes of Barrington Road for approximately two hours following the incident.

So much of the time accidents are produced by some exterior factor that inhibited a driver from being able to carefully drive, but this is far from always being the case. As shown above, accidents can happen even without the presence of any causing exterior factor. The reason: the road is a dangerous environment full of unexpected tragedies that sometimes just happen.

All it takes is one lapse in driving, which can occur in a quick moment, to have your own or someone else’s life changed forever. In the ensuing aftermath, you could be facing massive repercussions in the form of medical bills, restitution, loss of financial earnings, or any other number of fiscal burdens. Limit the extent of these repercussions and retain a proven accident attorney who knows all aspects of the relative law and can tactically create a plan that is committed to the well-being of your future.

Do not let yourself or someone you love fall victim to avoidable finances and charges. Get in touch with a skilled accident attorney at the Law Offices of Eugene K. Hollander who can stand by your side and fight to represent your rights and passionately protect your future.

Pedestrian Falls Victim to Train

Posted on

On Thursday night around 6:00, a southbound Coaster train in Encinitas made an unexpected stop after hitting and killing a pedestrian near the 1400 block of South Coast Highway.

The San Diego County sheriff’s department has launched an investigation into the details of the case, but as of now, there are not very many, including what the victim’s name was and whether or not this was a premeditated suicide or a horrible accident. The only truth we do know is that the victim was immediately pronounced dead at the scene, hopefully without any suffering.

Fatalities are sadly many times unexpected and almost always hard to deal with. They can happen when you least expect it and can take someone dear to you instantly, without any goodbyes. If you are fortunate enough, they might only amount to a serious injury, but what comes after both an injury and a death is an unwanted and untimely legal battle.

If you know someone or have yourself fallen victim to a regrettable train  accident, the train accident lawyers at the Legal Office of David Grey would like to encourage you to get in touch with a skilled attorney now who can take care of all of the legal ramifications and make sure that you are fully and adequately represented while you focus solely on a quick recovery. This can be an immensely painful process filled with burdens, but having the right attorney will allow yourself to ridden at least some of those burdens.

Deputy harmed for doing his job

Posted on

A deputy trying to do his job fell victim to the actions of another drunken driver. Around 4:46 a.m., the store manager at Love’s Truck Stop on U.S. 1 called for help as he noticed a customer to be clearly intoxicated with the intent to continue driving.

When the deputy arrived, he placed his patrol car in front of the perpetrator’s, prompting the perpetrator to try and flee by backing out. In the process of backing out, he pinned the deputy against the gas pump. He then fled the scene, driving the wrong way down U.S. 1, only to be eventually stopped with stop-sticks near Nova Road and Old Kings road.

Although initial reports do not indicate the status of the deputy’s possible injuries, there is no denying that people sustain injuries far too often because of the acts of an intoxicated person. It is because of this that the proper preparations are of that much more the essence. An experienced attorney can instruct you how to act in the midst of such an unfortunate occurrence, which will in turn hopefully lessen the effects and allow you to being your quick and speedy recovery.
